Annual Review of EHC Plan

An Education Health & Care plan must be reviewed every year at an ‘Annual Review’ meeting. The purpose of the review is to ensure that the contents of the EHC plan remains relevant. The EHC plan can be amended if necessary following the Annual Review – the school may recommend changes and parents can also ask for changes.

Everyone involved with the child or young person (parents, teachers, therapists, teaching assistants, etc) will be invited to the Annual Review meeting. A representative from the LA will also be invited. Attendees will be asked to provide a report which should be circulated to everyone two weeks in advance. The meeting itself will involve discussion of the child’s progress, the targets in the EHC plan and whether any changes are needed to the EHC plan. It is also a good opportunity to raise any concerns.

The school should write up a formal record of the meeting and state whether any changes are needed to the EHC plan. They should send this to the LA with all of the other reports no later than 10 school days after the meeting. The LA then decide whether to amend the EHC plan, the LA could also ‘cease to maintain’ the EHC plan. The LA notify parents of their decision within four weeks of the meeting. If the LA decides to make amendments to the EHC plan, they should send a notice of amendment outlining the propose changes.  The family then have 15 days to respond to the proposed amendment.  The final EHC plan should be issued no later than 8 weeks from the notice of amendment.
